Welcome to Crates ("Crates", "we", "us", "our"), a free-to-play online trading-simulator game operated by Crate Software Solutions. By creating an account or using the site at cratess.com (the "Service") you agree to these Terms of Service. If you do not agree, please do not use the Service.
You must be at least 13 years old to use the Service. If you are under 18 you should have permission from a parent or guardian, particularly before making any purchase.
You are responsible for keeping your login details secure and for all activity that happens under your account. Please tell us straight away if you believe your account has been accessed without your permission. One account per person; do not impersonate others or use another player's account.
Crates is a game. Credits, CrateCoin, ducks, crates, cosmetics and every other in-game item are virtual items with no real-world monetary value. They cannot be exchanged for real money, transferred off the Service, or "cashed out". You do not own them — you hold a limited, personal, non-transferable licence to use them within the game, which we may modify, suspend or remove.
Crates ("loot boxes") are a gameplay feature opened using in-game currency and yield in-game items only. Because no item can be exchanged for real-world money or prizes, the Service is not gambling and is intended purely for entertainment.
You may optionally buy CrateCoin, an in-game currency, using real money. Payments are processed by our payment provider, Stripe; we do not store your full card details. Prices are shown at the point of purchase.
Because CrateCoin is a digital item delivered to your account immediately, you agree that supply begins as soon as you complete the purchase and, to the extent permitted by law, that purchases are final and non-refundable once delivered. Nothing here affects any statutory rights you may have under UK consumer law; if you believe you are entitled to a refund, contact us and we will consider it.
You agree not to: cheat, exploit bugs, use bots or automated tools; attempt to access, probe or disrupt the Service or other accounts; buy, sell or trade accounts or items for real money outside the Service; post unlawful, abusive or harassing content in chat or profiles; or infringe anyone's rights. We may remove content and suspend or close accounts that break these rules.
The Service, its code, artwork and branding belong to Crate Software Solutions and are protected by law. You may not copy, resell or exploit any part of it except as the Service allows.
The Service is provided "as is" and "as available". It is a game that is actively developed, so features, the in-game economy and item values may change or be reset at any time. We do not guarantee the Service will be uninterrupted or error-free, and we are not liable for any loss of in-game items or progress.
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, and our total liability to you for any claim relating to the Service is limited to the amount you paid us (if any) in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
You may stop using the Service at any time. We may suspend or close your account if you break these Terms or if we stop operating the Service.
We may update these Terms from time to time. The "last updated" date above shows when. Continuing to use the Service after a change means you accept the new Terms.
These Terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales.
